Whatever you do, don’t speed to work in Maryland. Apparently, the cops in that state believe the appropriate way to handle speeding is to use an unmarked car with no lights or sirens to cut off the speeder, forcing them to stop, then jump out the car with no uniform or badge and fail to identify them self while he pulls out his gun and orders you off your vehicle. That’s what happened to Anthony Graber, who admitted to speeding. He was cited for doing 80 MPH on the highway. Fortunately for us, the story gets more interesting.
Anthony was riding with a video camera attached to his helmet to record his venture. It was still recording when it caught the cop acting like a thug. The police interaction takes place in the last 30 seconds.
The incident itself raises some interesting questions. First of all, the officer here comes off as an impulsive thug, not the image we should expect of our law enforcement officers. Second, as a concealed pistol license holder, I would probably interpret this officers actions as those of a car jacker or road raging murderer. If this happened to me or someone else who was carrying, it might have resulted in the officer and/or the motorist being shot. Not wise, officer.
But it gets worse…
A month after this incident cops found the video Anthony posted on youtube. Apparently furious that their behavior was exposed, they showed up to his home with a warrant for his arrest for felony recording without consent from the other party. Maryland is a two-party consent state for audio recording, but that is usually never upheld when there is no reasonable expectation of privacy – such as on the side of a busy road during a traffic stop. They also confiscated his cameras and computers. Anthony now faces five years in prison, but it seems likely the case will simply be thrown out. We’ll see. I think Anthony might be looking at a fat paycheck at the end of this.
UPDATE: I found the portion with the plain clothes officer with audio, so you can hear he clearly does NOT identify himself for several seconds AFTER he pulls out his gun.

No Audio no broken law. Why would he record audio anyhow since all one would hear is a high-pitched wine of the engine.
There is no intention to record the officer even if there was audio. He appears out of nowhere, doesn’t have any identification and pulls out a gun.
The biker would have been justified in running the guy over or doing anything else to defend himself.

I’ve strapped a camera to my bike before, but it while we were doing a local toy run for a Children’s Hospital where I lived. I left the video running while we stopped and chatted with people – even had kids waving at the camera.

It appears to me the guy may have even been off duty. Who knows and what a crock. There is no reason to draw a gun for speeding unless the person just robbed a bank or was running from the cops. The speed limit on that road was in the range of 55-65 MPH – meaning at most he was 25 over — pull a gun? WTF? Looks like a jack ass high on authority. I hope he is reprimanded for his douchebag actions.

That situation could easily have gotten out of hand.
This was an overly aggressive and irresponsible way for the police officer to handle this. He obviously did not think the situation through. He should have had a very clear idea of how he was going to handle the situation before he pulled alongside the bike. Quite obviously, this was an impulsive act; which should make his superiors question whether he should be allowed to drive around with a weapon.
At no time did he present any visual evidence of belonging to law-enforcement and in these situations, *saying* he was with the police would not do (most riders doing longer rides usually have ear-plugs so you can’t expect them to hear what you say).
The police officer was extremely lucky to pull over someone who was so calm so the situation did not escalate.
I would hope that for the sake of the public this officer was pulled off the streets, but I find it highly unlikely.

More than likely the rider was recording to take record of his drive. I know a few bikers that are now using a recording system to document accidents if they happen. That way a car driver will be documented coming over on a rider. I have seen it too often and had it happen to me as well. If I would have had this system I would have owned the person that caused my accident.

In Europe, we have something similar. They’re called “The Interceptors”. If you are speeding, they will pass you so that they’re in front of you, but then lights in the back windshield will go off saying “POLICE – STOP – POLICE – STOP” etc.

This is total crap. I once got pulled over by an off duty statie and the only reason I knew he was a cop was because he was telling me to pull over via microphone and he had 2 little flashing lights on his front bumper. For the longest time I thought he was some prick tailgating me so I was flooring it and switching lanes trying to get away from him. All states should have laws about cops have to be in marked cars with uniforms.

I’m sick of people saying that they were chasing me. Obviously, they are not motorcyclist!! I ride a CBR1000RR, 1 LITER, ~180hp. I would like to start by saying I would never run from the police. If someone was riding on my same bike, the cops would have never had a chance to catch that person. I’m not running. There were no lights. No sirens. Nothing. If you support me, thank you.

I think you deserved it. Want to treat the public highway like your own personal stunt track, endangering everyone elses life. And you want to act ‘offended’ because you were threatened because he had the gun out (Which was never directly pointed at you.). You obviously dont care about your own life, and an off duty cop had to take time out of his personal activity to pull you over. Maybe be more responsible about your riding instead of trying to transfer the blame. Far as the cop knows you were stealing a bike or high on drugs. Before getting too out of hand with the unidentified gun-toting motorist, notice that the state police had a marked squad car right behind this guy when he stopped. This was clearly a phone in traffic stop and mr. off-duty felt compelled to get involved (poor judgment).
The thing I find disturbing is that the video displayed what could be called “a normal day on a bike” since that’s how all bikes drive on the freeway, including motorcycle police bikes.
I really wish our paid thugs would focus more on real violent criminals than otherwise law abiding citizens out for an afternoon drive.

I am currently finnihsig up my BA in Child Development and Family Studies and thus far I have only work with children from 2 weeks to adolescent while helping support their families. The Physician that I would want to work under is an Obstetrics (OB) because they are in direct contact with pregnant women and their children during pregnancy. I would choose this particular specialty for a variety of reason such as having the opportunity to see individuals become parent for the first time, seeing how much love is surrounded in the process, being there to help the mothers while there in a vulnerable state. One of my main reasons is because I think that the whole birthing process is fascinating and to be able to be a part of family’s lives while going through this process, I imagine to be extremely rewarding.A of physician specialty that I would least want to work with would be a psychiatrist. Although I believe that psychiatrist do some spectacular work and help a lot of people through difficult situations I personally believe that this job would be to emotionally draining and overwhelming for me. This makes me question whether or not I would be able to handle it. When I set out to do a job my goal is to do the best that I can and I don’t feel that I could successfully do this job to the best of my ability.

Yeah the biker was wrong for speeding a little bit, but that isn’t a reason for a gun to be pulled out, cops be driving 25 miles over the limit for no reason, why ?? because they represent the law ?? what a way representing the law the way he did, more like a crack head thug trying to steel the bike, grabbing the bike and the rider like he did. I would have acted on self defense and knocked him out with my helmet. Then talked with the real cop behind that really acted like a cop, made a report, and taken this to court. Rights are equal to EVERYBODY.
Cops out there see a young guy on a bike or even cars, try to fuc* them any way they can, that’s why everyone should know their right as a citizen.
They don’t tell you that they are recording you when they stop you do they?? That camera looked like it was right in his face, that more than a warning that you are being recorded.

And the police spokesman Greg Shipley should be another one who loses his job. Shipley has said on the video “he held his gun at his side”. Is Shipley watching the same video we all are? I f I was the rider, I would have freaked out and probably ran off if someone jumps out like the officer did with his weapon drawn. And Shipley says that fear was put on the officer? Prime example how corrupt that organization is starting with the officer, the whole way up to the state attorneys office.

The bike is a Honda CBR1KRR, its top speed is at 12,000 RPM is 178 MPH. That’s factory specs. Some motorcyclists have hit top speeds of 182.6 MPH @ 13,000 RPM on this same bike. I looked at this video several times and made observations you may want to review for yourselves.
First of all try as I could the video did not show any posted speed limit signs so unless your familiar with this stretch of highway the speed limit is undeterminable at least to myself.. The Honda 1KRR has a circular tachometer that resembles a speedometer and is visible during most of the ride and that is an important thing to remember for later on. The tachometer’s increments are 1,2,3, etc. indicating engine revolutions in the thousands, 1 = 1000, 2 = 2000, 3 = 3000 etc.
There is a digital speedometer at the right lower corner of this tachometer greenish yellow in color with a black numerical display indicating miles per hour which was not readable to me during this particular run on the video.
Before you even start the video there is a gray car in the left lane next to the white bus, this appears to be the off duty, or unmarked (plain wrapper) State Trooper’s car. It is visible again at the 0:34 second point of the video as the motorcycle accelerates past the white bus, you see the car just briefly to the left of the screen still in the outside left lane only now in front of the bus. I believe that this is actually the time that the pursuit began.
This particular motorcycle has a six speed close ratio transmission. I believe the motorcyclist is in third gear at the beginning of the tape, although I can not visibly see the tachometer needle at this point to determine accurately the speed of the bike, also there is no audio to hear the shifts as they progress upward. However they are visible in the video. At 0: 24 seconds in the cyclist shifts into what I believe is fourth gear, watch the left hand depress and release the clutch lever on the handle bar. It appears that the cyclist pulls the front wheel off the pavement at the 0:32 point of the tape and sets it back down at 0:36. Also at the 0:36 just after setting the front wheel back on the pavement you can visibly see what I believe to be a fifth gear shift, followed by the sixth gear shift at 0:38. The irony here is that when the cyclist came out from behind the side of the bus he had the front wheel of the bike in the air. He went past the trooper in the unmarked car at what I would estimate to be at least 120 MPH. Then proceeded to catch two more gears after that at the 0:42 second point on the video I believe I can see the tachometer needle pointing at around 10 grand. If the cyclist is in sixth gear doing ten grand he is doing somewhere around 148 to 152 MPH. At 0:46 seconds he starts slowing down rapidly because there are three cars in front of him taking up all three lanes of traffic.
It is evident here that the cyclist has returned to a speed that is equal to other cars on the road. Now we come to 1:06 on the video, if you look to the left at this point on the tape you will see a Highway Patrol Car in the turn around lane waiting to give pursuit, this is the same car we see behind the biker at the end of the video.
At 3:13 on the video is when the trooper in the unmarked car pulls up on the cyclist’s right, the bike was already stopped in traffic at this point, the officer was attempting to prohibit the cyclist from either pulling forward past him or exiting down the ramp visible at the right. The gun was never pointed at the cyclist. When the officer pulled the weapon initially he pointed it out away from the car, over the guard rail and then down to his side. From 3:13 to 3:16 the motorcycle is rolling backwards away from the plain clothes trooper as if the biker is going to make a run for it. At the very end of the video the Highway Patrol Car you saw at the 1:06 time mark of the tape is now behind the biker and the officer.
Sorry folks the cops are absolutely correct on everything on this one. A few things to consider, if you come up behind an unmarked police car switch lanes and come out from behind a bus in excess of 100 MPH with the front wheel dangling in the air and grab two more gears accelerating to 150 MPH your suspect period. These officers had probable cause to pursue and apprehend. I will assume that the speed limit on that particular stretch of highway is 70 MPH, so the biker is right he was only doing 80 MPH, yeah 80 MPH over the speed limit. One more thing the officers don’t know diddle -squat about who you are or what your doing or have done, they don’t know if your an armed fleeing felon or just John Q. Public doing something stupid.
The police on this one are no way at fault the fault lies with the motorcyclist. If I were the prosecutor on this one I would show this tape in court it is self incriminating.

Anthony, I don’t believe that you were trying to elude the police after your high speed run. When your bike started to roll backwards away from the plain clothed officer after he pulled in front of your bike I was wondering just for a second if you were going to attempt to run, in this case the officers drawn pistol would have certainly been a deterrent would it not?
I find it odd that you found audio for the last few seconds of the video, where is the rest of the audio especially when you were accelerating through the gear sequences? I realize that to the unknowing viewer of this video one might mistake the tachometer for the speedometer and in doing so it might appear that you were only doing 80 MPH or so.
In reality the tachometer at that position places you at a much higher speed if you were in sixth gear, somewhere between 148 and 152 MPH.
It is hard to distinguish the read on the speedometer during the whole video with the exception of occasionally the red needle on the tachometer. The shadow from the sun is in front of the bike meaning the sun is at your back, this caused a reflective quality to be produced on the lens of the tachometer/speedometer revealing your helmet and face shield most of the time on the face of those instruments.
The bike looks new in the video, I believe that Honda came out with the CBR1KRR originally in 2003. Your bike looks newer 2008 – 2010 I would estimate. Here’s the thing what you did was gutsy I will give you that, the time and the place was stupid.
I would suspect that your charges are going to be excessive speed and reckless endangerment, which may or may not be a felony in Maryland. I did not see any elusive behavior at the end of the video nor was there any resisting arrest, I am confident that you were in fact arrested on the spot.
I don’t know you nor do I know your driving history or moving violation citations these will all play a part in the leniency of the court. You need an attorney to represent you in court. If I were you I would plea guilty with an explanation if this were a first offense and then ask for leniency from the court. This is a serious offense you may want to rethink it and tell the court it will never happen again and as for getting away on the bike its pretty much 50-50 these days. Bikes are fast but not as fast as radios which basically operate at the speed of light, 186,282.4 miles per seond.
Then there is always the eye in the sky possibility as fast as your bike is a helicopter can watch your travel rather well and call in locations as to where you are. I do not believe that eluding was a viable option in your case, I am confident that routes were already being put into play to apprehend you, the box was already forming around you, I think you were smart to stop when you did I will give you that.
The law enforcement in your case were just doing their job what you did was endanger peoples lives as well as your own and you did it with reckless abandonment from a legal point of view. The officers acted accordingly in responding to your actions on the highway at least that’s the way I see it, sorry sir.

I’ve not ridden a CBR1KRR, but I’m pretty sure that it will NOT wheelie in 4th gear without serious abuse of the clutch. And there is no indication of the clutch being used to lift the front wheel.
Further, you can actually see the speedo during the wheelie. It shows just over 100 mph at the end of the wheelie. I’d say that’s probably second gear, possibly third. The Kawasaki ZX10R in stock setup does about 105 mph in first gear, so second gear would take it up to well over 100 mph, and I expect the Honda to be a little lower, but not by any large amount.
And after that, I don’t see any point where the speedo shows goes beyond the 70’s (it’s not easy to read the speedo, but it is fairly clear from time to time in 720p mode).
Of course, speedos are known to be inaccurate – and more so if the rider has altered the gearing to make the bike accellerate/wheelie better.

I’m not sure I follow you on the speedometer reading of eighty miles per hour. I do not know the capability of the bike in question whether it has had engine work or gearing work done. It is possible that the bike was in a lower gear, there definitely is a shift at 0.24 on the tape, and the left hand pulls the clutch lever to the handle bar and releases it just before cyclist accelerates around the right side of the bus where he pulls the front wheel off of the ground. This could possibly a third gear shift. I just can’t see him cruising along at seventy miles per hour in first gear, may be though.
I do not know the video enhancement system you are using to arrive at the 80 MPH figure on the speedometer, perhaps you have a polarizing filter of some sort and a pixel enhancer I don’t know. For the majority of the run the only thing I really see on the large screen is the reflected image of the operator’s helmet and face shield.
You guys need to go to the site below this is a pretty good image of the tachometer and speedometer set up on a 2008 Honda 1000 RR going through the gears. If you look at the higher end painted white lane dividers and the frequency that they pass by are pretty much consistent with the rate that they pass by on the video of the bike in question. Look at the speedometer speeds at these times, both of these guys were booking!

I rode a 1971 Yamaha XS1 650 twin cylinder custom café style bike with an eighteen inch Harley rear wheel and Pirelli rubber all around. It was jet black with the front and rear fenders cropped. For its day it was pretty fast. The Harley rear wheel and Harley
cropped rear fender pulled it all together as did the custom Sportster style fuel tank. I kind of like theHarley Davidson 1200 Nighthawk, I’m not sure that they are still in production I believe it
was 2008-2009 only. That was kind of how my Yamaha XS1 looked. I just wore a skidlid with a chin strap, no ear protection and a pair of Ray Ban mirrored aviator shades.
I miss scootering around sometimes, there are just to many crazies on the roads these days that’s what keeps me in the four wheeler ride insiders. A hundred and five MPH in first gear, that was the top end on my bike from the factory before we reworked it. Its a totally different BIKEARAMA these days HUH?

You are right, we don’t know what mods the bike have, but I doubt it’s got nitrous oxide, turbo or extremely altered gearing – no wheelies in 4th gear – it will do around 150 in fourth at redline tho’.
Well, just comparing the bike with the traffic around, I’d say it’s not like the traffic is standing still – 150 mph, no way. The bike is faster than average traffic, but not whizzing past…
And I’d say the bike doesn’t speed up in the up changes after the wheelie (by any large amount).
I have a Kawasaki ZX-9R, and it does over 80 in first gear. It lifts the front in second under accelleration, and if you dump the clutch/mess up the gear change, the front wheel will come up in third too.

Why did the perpitraitor (who was breaking the law and putting other people at risk) post the whole video with no sound. Is there something he does not want us to hear. The video of the end of the chase shows a marked car and officer in uniform behind him. Did this officer have his siren and lights going? Did he use his loud speaker to tell the motorcyclist to pull over? Why did he look behind hmself seconds before the unmarked car cut him off?
Is this a trend, or one rouge officer?
I will wait for all the facts.

I believe you were right the bike was in first gear, he shifted it into second at the 0:24 mark on the video and went around the bus on the right side.
At 0:36 on Anthony’s bike video I was able to get one clear read of the odometer it is clearly 127 MPH. That makes sense; I believe that is also the time of the third gear shift, followed by fourth gear at 0:38. Third is geared for 140 MPH is @ 12,500 RPM.
There was one more gear shift so it is conceivable that he hit 130 MPH, sixty over the posted limit. I still think it’s going to be excessive speed and reckless endangerment with a motor vehicle.

While I find myself to someitmes (ok, frequently) be the only on in my organization who notices or cares about this issue, I feel caught between a rock and a hard place in terms of not stepping on Legal’s toes. In my current role, I actually wrote to the legal person in charge of copyright for the org to ask what existing policies etc. were in place, and he never even answered me!

This cop has done nothing wrong! If anything he had probably prevented anyone from being killed, including the idiot motor cyclist! Its funny the only people who seem to have a problem with the police are those who live on the wrong side of the law or are just too naive to look at the bigger picture. Why do people always think they can make a claim and spunge even more out of the tax payer than they already get! If this idiot killed a kid it would be a different.story then!

No one’s saying this guy shouldn’t have gotten a ticket. We’re saying he shouldn’t have been forced off the road at gun point, that was over the line. Have you ever sped on the road? Would you want a gun pulled on you for it? Seems unlikely.
Second, I don’t live on the wrong side of the law, neither do most libertarians. We are citizens who believe that everyone, including the police, should be subject to the law, a law that is limited in scope, is reasonable, and respects liberty. If that goal is at odds with some police officers then I would submit it is those police that are on the wrong side of the law.
